• We reserve the right to correct pricing errors, inaccuracies, or omissions at any time without prior notice.
• Payment must be received at the time of purchase via our approved payment processors.

C. Shipping and Delivery

• Products are shipped according to the delivery method selected at checkout. Risk of loss and title for items purchased pass to you upon delivery to the carrier.
• We are not liable for carrier delays, customs delays, or items lost/stolen once marked delivered by the carrier.

D. Returns and Refunds

Due to hygiene and safety regulations governing consumable wellness products, unopened and sealed supplements may be returned within fourteen (14) days of delivery for store credit or refund, subject to inspection.

When scheduling, paying for, or attending clinical consultations, virtual appointments, or medical intake through this site:

A. Nature of Telehealth Services

• Telehealth involves the delivery of healthcare services using interactive audio, video, or electronic communications.
• You understand that telehealth is not an emergency service. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

B. Provider Relationship & Jurisdiction

• Scheduling an appointment or submitting health history forms does not establish a patient-provider relationship until you are formally evaluated and accepted by a licensed healthcare provider affiliated with Viva Wellness Center.
• Clinical and telehealth services are only available to individuals located in states or jurisdictions where our medical providers are licensed to practice (e.g., the Commonwealth of Massachusetts). You certify that you will be physically present in a covered jurisdiction during your virtual appointment.

C. Prescriptions & Compounded Medications

• A consultation does not guarantee a prescription. Prescriptions (including compounded medications, peptide therapies, or medical weight loss medications) are issued strictly at the independent clinical discretion of the provider based on medical necessity, clinical intake, and required laboratory bloodwork.
• Compounded medications are prepared by state-licensed 503A/503B compounding pharmacies. They are not FDA-approved brand-name drugs.

D. Consultation Cancellation and Rescheduling Policy

• Cancellations or rescheduling requests must be submitted at least twenty-four (24) hours prior to your scheduled consultation time.
• Consultations cancelled with less than 24 hours’ notice or “no-shows” may be subject to a cancellation fee or forfeiture of the consultation deposit.

Unauthorized reproduction, modification, or distribution is strictly prohibited.

To the maximum extent permitted by applicable law:

• Viva Wellness Center, its owners, clinicians, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of this website, reliance on site content, or use of purchased products.
• Our total aggregate liability arising out of or related to these Terms or products sold through the site shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

You agree to indemnify, defend, and hold harmless Viva Wellness Center, its clinical providers, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, misuse of products, or provision of false health or identification information.

These Terms and any disputes arising out of your use of this site or transactions with Viva Wellness Center shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in state or federal courts located in Middlesex County or Boston, Massachusetts.
